If a decision is made by a Magistrate in the Local Court that is not favoured, an appeal can be made. A District Court appeal provides an opportunity for your lawyer to make submissions as to why a different decision should be made.
When you have been refused bail, a bail application can be lodged. It is your lawyers job to present submissions and advocate the conditions of your release.
Sentencing is the process by which a Magistrate presides over the penalties that will be given for each criminal charge. Your lawyer will be required to make submissions on your behalf to get the best possible penalty and result.
A defended hearing is a procedural process by which the case will be trialled before a Magistrate. Here, submissions and evidence will be used to formulate a decision and proven beyond reasonable doubt.
